24 P.S. Section 2070.9(b)

24 P.S. Section 2070.9(b) requires school entities to
report promptly to the department each instance
(1) where the school entity has dismissed a certified
employee for cause; and/or
(2) where the commissioned officer is aware that one
of his school entity's present certificated
employees has been formally charged or convicted
of a crime of moral turpitude or some other
offense requiring mandatory suspension or
revocation of certificate under this act.
Additionally, Section 49.64e of Chapter 49,
"Certification of Professional Personnel," requires school
districts, intermediate units and "the appropriate governing
body of the employing non-public school," to report to the
Secretary of Education within 10 days, the name of any
professional staff member who is dismissed for cause. Such
reports may be filed with the Office of the Deputy Secretary
for Higher/Postsecondary Education.
While the above situations are mandatory, the
Department of Education strongly encourages school officials
to similarly report educators who resign to avoid a
dismissal for cause, even if there is no formal charge or
conviction. The Department is particularly interested in
learning of instances where the educator may be a danger to
children.
The attached form may be reproduced locally as needed
for compliance with the laws cited above.
